Artist Agreement

This Artist Agreement ("Agreement") explains what happens when you upload or provide music to Niche Music, LLC ("Niche Music," "we," "our," or "us") for use on the Niche Music platform.

We tried to keep this straightforward.

You still own your music. This Agreement does not transfer ownership of your songs, artwork, artist name, or other materials to Niche Music.

By uploading music to Niche Music, submitting music for distribution on Niche Music, or otherwise agreeing to this Agreement, you agree to the terms below.


1. What You Give Us Permission to Use

When you provide a song or release to Niche Music, you give us permission to use the materials associated with it so that we can actually operate and promote the platform.

This may include:

  • Your song or audio recording
  • Song and release titles
  • Album or single artwork
  • Your artist name
  • Your artist profile picture or approved artist images
  • Artist and song descriptions
  • Credits
  • Lyrics, if you provide them and have the right to do so
  • Other artwork, metadata, or promotional materials you provide to us

We refer to these together as your "Artist Content."


2. How Niche Music Can Use Your Music

You give Niche Music a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, stream, display, and make your Artist Content available through Niche Music.

In plain English, this means we can do the things reasonably needed to make your music work inside Niche.

For example, we may:

  • Host and stream your songs through Niche Music
  • Display your music on song, album, artist, search, playlist, library, profile, feed, and discovery pages
  • Show your artwork, artist name, artist image, credits, and other information alongside your music
  • Create technical versions of your files when needed for streaming, playback, thumbnails, compression, formatting, or compatibility
  • Recommend or feature your music to Niche users
  • Include your music in playlists, discovery sections, charts, feeds, or other parts of the platform

This permission is non-exclusive, meaning you are still free to release, license, sell, stream, or distribute your music anywhere else.


3. Use in User-Generated Content

Niche is a social music platform, so users may be able to use or reference music while creating content on the platform.

You give Niche Music permission to allow users to use your songs through features that we intentionally provide inside Niche.

For example, users may be able to:

  • Attach your song to a post
  • Share your song with other users
  • Add your song to a playlist
  • Use a song or song clip as part of content created through Niche
  • Repost or interact with posts that feature your music
  • Use your music through other social or creative features we may add

This does not give users ownership of your music.

It also does not give users permission to download your song and use it however they want outside Niche.

Any use of your music in user-generated content must happen through features or permissions provided by Niche Music.


4. How We Can Promote You and Your Music

You also give Niche Music permission to use your Artist Content to promote:

  • Your music
  • Your artist profile
  • Niche Music
  • Features or content available on Niche Music

This may include promotional content on:

  • Niche Music's website
  • Niche Music's social media accounts
  • Promotional videos
  • Release announcements
  • Artist spotlights
  • Editorial content
  • App Store or product screenshots
  • Advertisements for Niche Music
  • Other marketing materials operated by Niche Music

For example, we may post a clip of your song with its artwork on Instagram to promote a release available on Niche, feature your artist profile in a video explaining Niche, or show a screenshot containing your music on our website.

We may crop, resize, compress, format, or combine artwork, artist photos, song clips, and similar materials as reasonably necessary to create this promotional content.

We will not claim that Niche Music created or owns your music merely because we promote it.


5. You Still Own Your Music

You keep ownership of your Artist Content.

Nothing in this Agreement transfers your copyright, master ownership, publishing ownership, trademark rights, or other ownership rights to Niche Music.

We are receiving permission to use the content in the ways described in this Agreement.

You may continue distributing your music through Spotify, Apple Music, YouTube, SoundCloud, Bandcamp, labels, distributors, your own website, or anywhere else.


6. Payment

Niche Music does not currently pay artists for streams or other uses of music on the platform.

By providing music to Niche Music under this Agreement, you understand that the permissions you grant us are currently royalty-free.

We hope to introduce artist payments or revenue sharing as Niche Music grows and begins generating enough revenue to support them.

If we introduce payments in the future, they may be based on things such as:

  • The number of legitimate streams a track receives
  • How music is used within Niche
  • Revenue generated by the platform
  • Other factors we determine as part of an artist payment program

However, this Agreement does not guarantee that Niche Music will introduce payments or that you will receive any particular amount of money.

Any future royalty, revenue-sharing, or artist-payment program may be governed by additional or updated terms explaining how payments are calculated and distributed.

We will not retroactively charge you for having music on Niche.


7. Rights to the Music You Upload

You may only provide music or other materials that you have the right to provide.

By submitting Artist Content to Niche Music, you confirm that:

  • You own the content or have permission from the people who do
  • You have the rights necessary to let Niche Music use it under this Agreement
  • The content does not knowingly infringe someone else's copyright, trademark, publicity rights, or other legal rights
  • Any collaborators, producers, featured artists, labels, publishers, photographers, designers, or other rights holders have given any permissions required for you to submit the content

You do not need to personally own every right involved if you have authorization from the person or company that does.

For example, an artist signed to a label may only upload a recording if their agreement with that label allows them to do so.


8. Collaborations and Multiple Rights Holders

Music often has more than one rights holder.

If you submit a song containing work from another artist, producer, songwriter, photographer, designer, label, publisher, or other contributor, you are responsible for making sure you have the permissions necessary to submit it.

Niche Music is not responsible for determining ownership splits between artists, producers, songwriters, labels, publishers, or other parties.

If multiple people claim rights to the same content, we may temporarily restrict or remove the content while the issue is resolved.


9. Removing Your Music

You may request that your music be removed from Niche Music.

Where removal tools are available in your artist account, you may use those tools. You may also contact us at hello@nichemusic.app.

We will make reasonable efforts to stop offering the requested music for new streaming through Niche within a reasonable period of time.

Some copies or references may remain temporarily because of:

  • Technical caching
  • Backups
  • Moderation or legal records
  • Existing user posts
  • Existing promotional materials
  • Content that has already been published or distributed

We do not have to recall or delete promotional posts, screenshots, videos, or other materials that were lawfully created and published while your license was active, although we may remove them at our discretion.

After your music is removed, we will not use it in new promotional materials unless we receive permission again or otherwise have the legal right to do so.


10. Artist Profiles

Niche Music may create or maintain artist pages containing information associated with your music.

This may include your:

  • Artist name
  • Profile picture
  • Biography
  • Releases
  • Artwork
  • Credits
  • Links
  • Streaming information
  • Other relevant artist information

You give us permission to display this information as part of your presence on Niche Music.

If information about your artist profile is incorrect, you may contact us or use available artist tools to request a correction.


11. Editorial Features and Spotlights

Niche Music may publish editorial content about artists and releases, including recommendations, reviews, interviews, spotlights, news, or similar content.

If you provide us with photos, quotes, artwork, videos, press materials, or other content specifically for an editorial feature, you give us permission to use that material in connection with the feature and its promotion.

Unless we separately agree otherwise, participation in an editorial feature does not mean that Niche Music owns your materials or represents you as your label, manager, agent, or publicist.


12. No Exclusivity or Artist Representation

Uploading music to Niche does not create an exclusive relationship between you and Niche Music.

Unless we enter into a separate written agreement, Niche Music is not your:

  • Record label
  • Distributor outside Niche
  • Manager
  • Agent
  • Publisher
  • Employer
  • Business partner

Nothing in this Agreement prevents you from working with any other platform, distributor, label, manager, or company.


13. Fraudulent or Artificial Streaming

If Niche introduces artist payments, rankings, charts, recommendations, or other benefits based on streams or engagement, those systems must reflect legitimate user activity.

You may not intentionally manipulate Niche activity through methods such as:

  • Bots
  • Automated streaming
  • Fake accounts
  • Stream farms
  • Paid artificial engagement
  • Coordinated activity intended primarily to manipulate metrics

We may remove fraudulent activity from statistics, rankings, or future payment calculations.

Serious or repeated manipulation may result in removal of music or suspension of an artist account.


14. Copyright Complaints

If someone claims that Artist Content you submitted infringes their rights, we may investigate the complaint and may temporarily restrict or remove the content.

We may contact you for additional information or proof that you have permission to use the material.

15. Changes to Your Music or Files

We will not intentionally alter the creative substance of your song and present the altered work as your original recording.

However, we may technically process files when necessary to operate Niche.

This may include:

  • Audio transcoding
  • Compression
  • Changing file formats
  • Normalizing technical playback properties
  • Creating previews or clips
  • Resizing artwork
  • Cropping images for different layouts
  • Creating thumbnails

These technical changes do not give Niche Music ownership of the underlying work.


16. Our Platform Can Change

Niche Music is still developing, and the way music appears or works on the platform may change.

We may add, change, or remove features such as:

  • Artist profiles
  • Music discovery
  • Playlists
  • Charts
  • Social music features
  • User-generated content features
  • Music playback
  • Recommendations
  • Artist analytics
  • Payment systems

Providing music to Niche does not guarantee that any particular feature or placement will remain available permanently.


17. Removal by Niche Music

We may remove or restrict Artist Content if we reasonably believe that:

  • It violates this Agreement
  • It violates our Terms of Service or Community Guidelines
  • You do not have the rights necessary to upload it
  • We receive a credible copyright or legal complaint
  • The content creates a security or legal risk
  • The content is being used to manipulate the platform
  • We are legally required to remove it

We may also discontinue hosting particular content or services as Niche Music evolves.


18. Relationship to Other Niche Agreements

Your use of Niche Music may also be governed by our:

  • Terms of Service
  • Privacy Policy
  • End User License Agreement
  • Community Guidelines

This Artist Agreement specifically governs your relationship with Niche Music when you provide music and related Artist Content to the platform.

If another agreement conflicts with this one specifically about artist uploads or the rights you give Niche Music to use Artist Content, this Artist Agreement controls for that issue unless another written agreement expressly says otherwise.


19. Ending This Agreement

You may end this Agreement by removing your Artist Content from Niche and stopping use of artist-specific features.

Niche Music may also end this Agreement or your access to artist features if necessary under this Agreement or our Terms of Service.

Ending the Agreement does not undo uses of your Artist Content that were properly made while the Agreement was active.

For example, a social media post Niche lawfully published while your song was available does not automatically become unauthorized because you later remove the song.

Sections that logically need to continue after termination, including ownership, previously authorized uses, copyright responsibilities, and dispute provisions, will continue to apply.


20. Changes to This Agreement

We may update this Agreement as Niche Music develops.

If we make a material change to the rights you give us or to artist payment terms, we may provide additional notice or ask you to accept the updated Agreement before continuing to use certain artist features.

The version and effective date at the top of this page will show when this Agreement was last updated.


21. Governing Law

Except where applicable law requires otherwise, this Agreement is governed by the laws of the State of Maryland, without regard to conflict-of-law principles.

Nothing in this Agreement removes legal rights that cannot be waived under applicable law.
